Enduring Powers of Attorney
An Enduring Power of Attorney is a document that allows you to appoint someone to make financial and legal decisions for you—but not health and wellbeing decisions—while you’re still alive.
Enduring Powers of Attorney cease to function when you pass away—once you pass away, your Will (if you have one) becomes active instead.
If you haven’t appointed anyone under an Enduring Power of Attorney to make decisions for you, there’s a risk that the South Australian Civil & Administrative Tribunal (SACAT) could make orders giving such power to a person or people you would not be happy with.
We can help you
- Determine who you want to appoint under an Enduring Power of Attorney
- Set down exactly who you want to give the power to make decisions for you
- Impose any restrictions you may want on that power—for example, do you want someone to be able to make decisions for you only if you’re incapacitated and cannot make decisions for yourself? Or do you want someone to be able to make decisions for you regardless?
